How to Verify a Freight Broker Bond

If you’re new to working with freight brokers, you may be confused about the role of their surety bond. From the Carrier’s standpoint, the surety bond is in place as protection in case the broker refuses to pay for services rendered. Always verify a freight broker’s bond before accepting a load.

Visit the Federal Motor Carrier Safety Administration (FMCSA) website. Go to the Licensing and Insurance section and choose Carrier Search from the drop down menu.

Enter the freight broker’s information. It isn’t necessary to fill out the entire form. If you have the Motor Carrier (MC) or Freight Forwarder (FF) number, no other details are necessary. If you don’t, fill in as much information as you can. Hit “Search.”

Choose the correct broker from the formulated list. Click on “Report.” (HTML shows a snapshot of some pertinent information. Report provides full FMCSA information about the broker in PDF format).

Note the Authorities section. Freight brokers must have current brokerage authority for their surety bond to be valid. Be sure the broker authority listed is active; with no application pending. If the broker authority status is listed as None or Inactive, the company has no current legal standing as a freight broker. Don’t take the load; the broker bond (if any) won’t be enforceable.

Drop down to the Insurance Requirements section. Look for bond insurance. If the freight broker is acting in accordance with federal law, it will list bond insurance as both required and on file. It will also show the current federal minimum requirement of a brokerage surety bond. (Note: Some brokers voluntarily purchase a larger bond. The federal minimum will show regardless of actual bond value).

Look down the page at Active and Pending Insurance. Verify a listing for an active broker bond. (Note: If the freight broker has changed insurance companies, cancelled bonds will also show on this form).

Call the insurance carrier to clarify coverage if desired. Many trucking companies find this step unnecessary, because the insurance company is required by law to notify the FMCSA if coverage ends. However, a short time lag can be possible between a bond lapse and an FMCSA update. If you want to be 100% certain the bond is in effect, note the bond number and use the insurance contact information on the form.

Senate bill would raise truck weight limits

Federal truck weight reform legislation that would give each state the flexibility to raise interstate weight limits has been reintroduced in the U.S. Senate.The Safe and Efficient Transportation Act (S. 747) is sponsored by Sens. Mike Crapo (R-Idaho), Herb Kohl (D-Wis.), Susan Collins (R-Maine) and Rob Portman (R-Ohio).Like identical companion legislation pending in the House of Representatives, SETA would give each state the option to raise interstate weight limits selectively from 80,000 pounds to up to 97,000 pounds. The higher limit applies only to vehicles equipped with six axles instead of the typical five. The additional axle would not affect truck size, but would allow shippers to use extra cargo space.

“SETA is a narrowly drawn bill that enables companies to move a given amount of product in fewer vehicles without adding more weight per tire or increasing stopping distances,” said John Runyan, executive director for the Coalition for Transportation Productivity, a group of more than 180 shippers and allied associations backing the legislation.The American Trucking Associations previously has estimated that the trucking industry will haul 30 percent more tonnage in 2021 than it does today. If current weight restrictions remain the same, ATA estimated the U.S. economy will require 18 percent more trucks on the road driving 27 percent more miles than they do now. Runyan said SETA would help correct this imbalance by allowing shippers to reduce truckloads, fuel, emissions and vehicle miles traveled for each ton of freight shipped.

CSA 2010: Resentment by the Trucking Associations

The United States three main Trucking Association: the Expedited Alliance of North America (TEANA), the National Association of Small Trucking Companies (NASTC) and the Air and Expedited Motor Carrier Association (AEMCA), who own fleets more than 3,000 in number has filed a lawsuit in the court to review the rules and regulations as imposed and stated in the FMCSA’s CSA2010 legislation. The suit has been filed in the United States Court of Appeals. The association wants that the FMCSA release of these safety regulations should be permanently rejected by the court as they do not approve of the safety methods laid down by the FMCSA’s CSA 2010 release.
The court has previously rejected the Trucking Association’s plea to release a temporary hold order so that they could avoid the release of the CSA2010 safety regulations before time. This injunction was filed by the association earlier this month. Due to the fast movement of actions the Federal Court has agreed to hear both parties on the issue to release an order against FMCSA’s Comprehensive Safety Analysis initiatives. In their appeal the trucking associations emphasized that the FMCSA fails to understand the impact that this legislation will have on the small trucking companies and owner operator jobs.
The monitoring and the records will be open to public on the CSA website. This will enable all the reports for any carrier or truck driver available for the public to ponder on it. All warnings, accidents, safety implications and others will be updated online for every incident. This measure is beneficial for shipping company as they can use the data to judge on who should be employed to carry their available loads. The FMCSA and other government authorities would work in close compliance to report the statistics on Behavioral Analysis and the Safety Improvement Categories.
